The competent decision-making authority is the National Directorate-General for Aliens Policing, information regarding residence permit for the purpose of employment, the application form and appendix can be found on the website of the authority.

Guest workers

  1. whose purpose of residence is to perform actual work for or under the direction of others, for remuneration, under contract for employment relationship,
  2. whose employment is based on an existing employment relationship with an employer established in a third country, in order to fulfil an agreement concluded with a Hungarian employer (in this case the Hungarian employer is considered to be the employer)

may be granted a residence permit for employment.

The type D visa entitling its holder to receive a residence permit shall be issued by the Consular Office.

Please note that type D visa entitling their holder to receive their residence permits issued to third-country nationals is a single-entry visa authorising a stay of not more than 30 days and is valid for 3 months.

 

 

Please note that if you do not enter the territory of Hungary within 3 months from the date of approval of the issuance of your residence permit and do not start your approved residence, the approved residence permit becomes invalid and the approval of your accrued right of entry and residence ceases.

The application can be accepted only if you submit the documents as follows:

 

  • filled and signed application form for the residence permit and Appendix No. 9.6

•     valid passport with at least 2 blank pages (and previous passport/s, if any)

•     2 passport photos

  • flight booking
  • health insurance
  • CV and motivation letter
  • police character certificate
  • not mandatory: birth certificate of the applicant, in case of the applicant’s marital status is married, marriage certificate

FOR THE PURPOSE OF EMPLOYMENT:

  • a preliminary agreement on establishment of an employment relationship issued by the Hungarian employer
  • a document on legal relationship of employment

FOR THE PLACE OF ACCOMMODATION IN HUNGARY:

  • a residential lease contract
  • a document on accommodation by courtesy
  • a document in proof of ownership of the residential property
  • a document in proof of the reservation of accommodation and payment for it
  • a certificate by the applicant’s employer declaring that the employer will provide for the applicant’s place of accommodation

 

FOR THE DOCUMENTS IN PROOF OF MEANS OF SUBSISTANCE IN HUNGARY:

  • a preliminary agreement
  • a document on legal relationship of employment
  • the applicant’s own bank account statement/s for the last 6 months, signed and stamped by the bank
  • a document on regular income issued by the employer or the tax authority, if any
  • previous employer’s certificate, if any 

Please be noted that every decision is made on case-by-case basis, therefore the authority may request the submission of further documents for clarification of facts!

Time period for procedural administration: 21 days

In addition to mandatory attachments/enclosures, the authority may request the submission of further documents for clarification of facts of the case or implement other procedural conducts.

The period for remedying deficiencies (e.g. submission of missing documents) and for the implementation of various other procedural conducts is not comprised in the time period of the procedural administration. 

The authority acting on the application for a residence permit for employment case adopts a decision as to merits within 70 days from the date of the submission of the application.

!!FAMILY MEMBERS OF ANY THIRD-COUNTRY NATIONAL HOLDING OR APPLYING A RESIDENCE PERMIT FOR THE PURPOSE OF EMPLOYMENT CANNOT APPLY FOR A RESIDENCE RERMIT ON THE BASIS OF FAMILY REUNIFICATION!!
